HubSpot recently updated the following documents, which we are including here for your convenience, that may apply to your use of our services or websites:

Solutions Partner Program Agreement (previously updated June 2, 2025)
Optional Partner Program, Pilot and Beta Specific Terms (previously updated October 1, 2025)

We've also made minor drafting clean-ups and clarifications across the terms.

We wanted to give you some information on what's changed below. Please remember that this is just an informal, high-level summary of the most recent changes to these documents, and that you should always make sure you've read and understood the complete HubSpot Solutions Partner Program Agreement before you participate in our Solutions Partner Program.

HubSpot Solutions Partner Program Agreement

We've added a table of contents at the beginning of the Agreement and updated section numbering and formatting throughout to improve navigation in the document.
We've added several new program definitions to support program updates, including Program Rules of Engagement (rules for how partners work with our sales team), Touchless Credit (Revenue Share and/or Sold MRR tier credit related to Touchless Purchase transactions), Touchless Purchase (purchases made by End Users directly from HubSpot without partner or sales team involvement), and Upsell (transactions where partners can earn Revenue Share and Sold MRR tier credit when upselling existing HubSpot customers to higher MRR).
We've clarified how Cross Sell transactions work, including updated eligibility criteria and our discretion in determining applicability. Cross Sell is now defined as transactions allowing partners to earn Revenue Share and/or Sold MRR tier credit on sales of Subscription Services to existing End Users, subject to eligibility requirements.
We've updated the Shared Deal definition to clarify that only closed-won Shared Deals with appropriate proof of involvement (POI) attached will be eligible for Revenue Share and credit consideration. Revenue Share and credit will not be granted retroactively on deals that don't meet these requirements.
Partners may now be eligible to receive Revenue Share for Touchless Purchases on product lines where they hold the most recent closed-won Shared Deal, provided certain timing and eligibility conditions are met as outlined in the Program Rules of Engagement.
We've clarified how Revenue Share is calculated for different transaction scenarios, including Net Upsells (partners receive Revenue Share on net Upsell MRR for product line upsells), Downgrades (Revenue Share is reduced pro rata when product line MRR downgrades occur), Edition Tier Upgrades (tier upgrades from Starter to Professional or Enterprise are eligible for Revenue Share on the net upsell amount), Legacy Revenue Share (continued Revenue Share for partners managing legacy product lines, subject to quarterly review), and Previous Transactions (upsell transactions on a product line before November 17, 2025, are not considered Qualified Transactions).
We've updated the Proprietary Rights section to clarify that partner feedback (solicited or otherwise) when it comes to our products, services, pricing or programs will not be Participant Confidential Information and HubSpot owns all rights to use and incorporate it without payment or attribution.
Our notice address has been updated to direct correspondence to the attention of "Legal”.

Optional Partner Program, Pilot, and Beta Terms

We have deleted the ‘Beta Specific Details’ for the ‘Deal Based Model Beta’ section in its entirety, as this Beta has moved to general availability, and the applicable details can now be found in the Solutions Partner Program Agreement.

Please note, the applicable termination notice for the Deal Based Model Beta is covered under the announcement that the Solutions Partner Program Agreement has been updated for global, general availability.

For the past 19 years, my clients hire me for sales/marketing conten - custom 2D/3D animations, medical/technical illustrations/animations. video, ROI/TCO calculators, and very recently AI-enabled Account based marketing and competitive intelligence reports.

My goal for the remainder of this year, is to figure out HubSpot's core capabilities, best practices, and integration. A bit of a newb as a "Markerter," but I've learned a bit via osmosis over 10,000 hours of projects.

General Terms

To avoid doubt, we added express language in the Order Form definition incorporating your Order Form into the Agreement in the ‘Definitions’ section of the General Terms. You’ll see changes consistent with this in the ‘Precedence’ section as well.
We’ve updated the URL at the end of the “Third-Party Products” definition to direct to the now-current webpage.
We’ve worked to streamline the definition of Subscription Services to apply broadly unless specifically indicated otherwise in the Product Specific Terms. You’ll see changes consistent with this in the ‘Subscription Fees’ section as well.
We’ve added the ‘Set Off and Collection’ subsection in the ‘Fees’ section.
In an effort to ease your review, reference to machine learning and artificial intelligence algorithms are now generally referred to as AI models.

Data Processing Agreement

We updated the URL for the “UK Addendum” in the ‘Definitions’ section of the Data Processing Agreement in an effort to remedy access issues some users may have encountered.

Sub-Processors Page

In the ‘Feature Specific Sub-Processors’ section you'll see updates for each Sub-Processor on the Sub-Processors Page indicating how their data handling relates to each of the hosting locations we offer.

Privacy Policy

To remain consistent with the General Terms, reference to machine learning and artificial intelligence algorithms are now generally referred to as AI models in the Privacy Policy as well.
We removed a reference to prior dispute resolution processes which have since been sunsetted and replaced with the options available in the Privacy Policy.

Product Specific Terms

In the ‘Marketing Contacts Products Email Send Limit’ section of the Product Specific Terms, we corrected the reference back to the ‘Fees’ section of the General Terms and removed the sunsetted reference.
In the ‘Commerce Hub’ section, we’ve clarified Stripe payment processing and HubSpot payments are an additional service available outside the scope of our Subscription Services, and are subject to terms and conditions instead of the General Terms.
We’ve made similar updates to the ‘Commerce Hub Fees and Payment’ section, further clarifying some features within Commerce Hub may have separate fees that apply.

Jurisdiction Specific Terms - Europe

We’ve added the EU Data Act Addendum available at https://legal.hubspot.com/eu-data-act-addendum to the ‘Compliance With Laws’ section of these jurisdiction specific terms.

General Terms

You can seamlessly scale your credit usage to match your growth momentum with new flexibility using HubSpot Credits!

You'll see "Overages" added to the 'Definitions' section of the General Terms and used throughout the Agreement to support additional options you now have to manage HubSpot Credits in your account.
If you participated in the Breeze Intelligence Overages beta, the beta has ended now that Overages are available to everyone using HubSpot Credits.
You can learn more about how to configure your account to manage HubSpot Credits in the "Understand HubSpot Credits and billing" knowledge base article.

We've deprecated the definition of "Contact Information" and introduced a definition for "Limits" in the Agreement.
We’ve added headers and subsection identifiers to existing provisions for easier navigation.
The 'Subscription Fees' section has been updated to include HubSpot Overages and outline options for how you may choose to engage with additional features impacting your fees.

We've also added a HubSpot Terms Tip with the "Understand HubSpot Credits and billing" knowledge base article where you can learn more about how to configure your account to manage HubSpot Credits and feature Limits.

The 'Notice of Non-Renewal' section now clarifies and includes information on how to disable your next renewal within your account if you choose not to renew.
The subsection previously titled 'Data Practices and Machine Learning' is now 'Data Practices'.
Similarly, the subsection previously titled 'Machine Learning' is now 'Machine Learning and AI', and we've clarified how Customer Data may be used to improve HubSpot AI features and functionality.

You can still opt out by emailing privacy@hubspot.com and we've added the "Opt out of HubSpot's machine learning data use" knowledge base article if you’d like more information.

We removed the 'Usage Data' subsection and references throughout the General Terms; you can find information about Usage Data in our Privacy Policy.
In the 'HubSpot Tracking Code and Customer Websites' we removed the duplicative reference to the Products and Services Catalog.
We've updated the 'Performance Warranty' section to reflect a prorated refund to the customer in the event either party terminates if non-conformance issues cannot be resolved within the remedy period.
We added the 'Contracting Entity Precedent' subsection to specify that the HubSpot entity identified on your Order Form is your contracting entity, even if it's different from the entity specified in the Jurisdiction Specific Terms Appendix.
Since we launched HubSpot India Private Limited with jurisdiction specific terms including governing law, we removed the redundant reference to governing law in the Jurisdiction Specific Terms Appendix.

Data Processing Agreement

In the Data Processing Agreement, we corrected terminology in the Data Processing Agreement, updating "Processor-to-Controller terms" to "Controller-to-Processor terms" for accuracy.

Sub-Processors Page

We've updated the language in the Feature Specific Sub-Processors table on the Sub-Processors Page:

The details for Amazon Web Services, Inc., Google LLC, and OpenAI, L.L.C. now reflect the Purpose as "AI service provider" and "HubSpot AI" as the Applicable Service.
Similarly, you'll see updates for these Sub-Processors in the European Union Data Center column, including European Economic Area regions.

Sensitive Data Terms

We updated the Sensitive Data Terms to streamline the essential legal language and moved feature details, like the Covered Services and Permitted Sensitive Data, to the Sensitive Data section of our Product and Services Catalog.

Product Specific Terms

The 'Generative AI' section is now 'HubSpot AI' meaning the products, features, or functionality that incorporate artificial intelligence (AI). You'll see updates consistent with this change across the terms.

We’ve added links to "HubSpot AI Cloud Infrastructure Frequently Asked Questions" and "Manage your AI settings" knowledge base articles for more information and options.

We've updated the 'HubSpot Seats' section to remove the 'Free Services' and 'Adding Seats' subsections. You can visit the Product and Services Catalog for details on seat types and adding seats.
You'll see additional details in the 'HubSpot Credits' section, including the options for capacity pack upgrades and overages.

We've added the "Understand HubSpot Credits and billing" knowledge base article for more information about how to configure your account to manage HubSpot Credits and feature Limits.

In the 'Commerce Hub' section, we removed the 'Limits' subsection and added clarifying language that Billing Migration may be subject to different fees and terms, as described in the Product and Services Catalog.
Operations Hub is now Data Hub—same powerful capabilities, evolved to emphasize unified data management. You’ll see this update across the documents.

Payments Terms of Use

We’ve refined the language in the 'HubSpot’s Role' section in the Payment Terms of Use.
We updated and added definitions for “Bank Account,”and “Payment Processor Terms.”
We may make certain tax features available to you, and you ultimately determine the configuration that applies to your business.
We’ve clarified you are responsible for your compliance obligations, including where you impose any fee or surcharge to your customers.
The 'Data Privacy' section now includes references to data collection at checkout and obtaining consent for data processing for your customers.
In the 'Verification and Underwriting' section, we've added language authorizing your wireless carrier to use or disclose account information to help identify you and prevent fraud during your business relationship with HubSpot.

Payment Terms of Use:

We’re excited to announce that HubSpot Payments will be available to customers in Canada and the United Kingdom in Q3! As part of this expansion, the HubSpot Payments Terms of Use now include an Available Jurisdiction Appendix, which is also included in the defined terms and referenced throughout the document.
All references to “ACH” have been updated to “direct debit” for consistency.
We have streamlined our compliance language by removing specific examples, making the terms easier to review.

Website Terms of Use

The Claims of Copyright Infringement section in the HubSpot Website Terms of Use has been updated to reflect our new claim intake process. We have also simplified this section to make your review easier.

Optional Partner Program, Pilot and Beta Specific Terms:

Throughout the Optional Partner Program, Pilot and Beta Specific Terms, we’ve worked to ease your review by consolidating information under the new ‘Optional Program General terms’ section, and applying carrying through those updates across the document.
We’ve also included formatting updates, including new section headers and consistent number in an effort to ease your review.
We've clarified they're an extension of the HubSpot Solutions Partner Program Agreement (HSPPA) and intended to allow HubSpot to innovate and test new offerings with partners.
We’re pleased to announce key updates to the APAC Upmarket Referral Pilot, aimed at making the program even more rewarding for Solutions Partners in the APAC region:

A new H2 Pilot term has been added, running until December 31, 2025, and subject to the full terms and conditions.
“DIFM” deals are now referred to as “Partner Assisted” deals to better reflect your role.
The minimum Monthly Recurring Revenue (MRR) for Partner Assisted deals has been lowered to USD $1,000+.
Eligible Partner Assisted deals now qualify for a 20% Revenue Share for up to twelve months.
Platinum, Diamond, or Elite tier Solutions Partners in good standing who sell to customers in the APAC Pilot Region are eligible.
To qualify, deals must be referred by a HubSpot Global Sales (GS) representative and involve new or existing HubSpot customers purchasing Professional or Enterprise level Subscription Services.
Eligible HubSpot Solutions Partners in APAC growth markets will be automatically included in this pilot.

HubSpot Developer Terms

For clarity, we have included Model Context Protocol (MCP) server(s) within the definition of “Developer Tools” in the HubSpot Developer Terms.
The ‘Monitoring’ section is now titled ‘Monitoring and Compliance’ and outlines developers’ reasonable efforts to support compliance requests as detailed in the terms.
A new ‘Indemnification’ section has been added, outlining legal responsibilities in the event of legal action.

We’re excited to launch HubSpot Credits! We've updated the General Terms ‘Fees’ section to include references to new HubSpot Credits.
We worked to refine the ‘Entire Agreement’ section by clarifying applicable Orders are included.

Product Specific Terms

The new ‘HubSpot Platform Access’ section in the Product Specific Terms includes the existing HubSpot Seats information and the new HubSpot Credits details.
You can now use HubSpot Credits to engage with our Enrichment Products. As a reminder, using Breeze Intelligence tools in HubSpot (Enrichment, Intent, Smart Properties, Data Tests, and similar features), is subject to the ‘Enrichment Products’ section of the Product Specific Terms and throughout the Agreement.
The ‘AI Products’ section is now ‘Generative AI’, and you’ll see that reference updated throughout the terms.
The ‘Call Recording’ section is now ‘Recording of Calls and Other Electronic Communications’, and we’ve updated the section to reflect use and compliance obligations.

Data Processing Agreement

We updated the ‘Transfer Mechanisms’ section of the Data Processing Agreement to have the Standard Contractual Clauses apply, in addition to the Data Privacy Framework.

Sub-Processors Page

We’ve updated the ‘Feature Specific Sub-Processors’ section of the Sub-Processors Page as follows:

We simplified the Applicable Service descriptions throughout the page.
As described in the Product Specific Terms summary, we updated references to “Generative AI” from “AI Products” to align with other updates across our terms.
We simplified the subprocessing details to more easily identify reCAPTCHA and added Speech to Text to support calling and transcription being enabled for most customers using call recording.
We’ve removed duplicative language from the table indicating features may be optional. Any optional Sub-Processors are already marked on the page with an asterisk indicating you may choose not to use the functionality provided by our Sub-Processors.

Privacy Policy

We refined the ‘Partners’ section of the Privacy Policy to clarify the purposes for data processing applicable to HubSpot partners.
We’ve added a new section, ‘HubSpot Marketplace,’ to describe how personal information may be processed when using a HubSpot Marketplace.
We updated the 'Data Privacy Framework Notice' section to include our commitment to cooperate with relevant data protection authorities regarding unresolved complaints about personal data handled under the Data Privacy Framework.
In the ‘Google Products And Integrations’ section, we moved resources to learn more to the top of the section for ease of reference.
We added a new ‘Google Speech to Text’ section to describe how Customer Data may be used to provide features within our services.

HubSpot Solutions Partner Program Agreement

We’ve updated the ‘Definitions’ section in the Solutions Partner Program Agreement to include several new terms and updated information:

You’ll see a new entry for “Partner Beta Program” which is also included throughout the document and the new Optional Partner Program, Pilot and Beta Specific Terms.
We’ve included a new entry for “HubSpot Credits” based on our product updates, which are now referenced throughout the agreement.
We’ve updated the definition for “List Price” to focus on current pricing and remove language related to the previous 10-day option.
We added a new definition for your “Subsidiaries” which has been incorporated throughout the agreement, as applicable.

We’ve expanded the ‘Partner and Provider Rights’ section to allow your Subsidiaries to demonstrate and promote the HubSpot Products to your prospects and customers. Similarly, we’ve also included your responsibilities for your Subsidiaries.

We’ve also updated the contents of this section, program obligations and compliance requirements, currency information, and other impacts of optional programs (applicable in the event you participate in one of these Optional Partner Programs).

We've incorporated the new Optional Partner Program, Pilot and Beta Specific Terms in an effort to make information about specialized partner programs easier to review. We've moved this content from the previous Partner Jurisdiction Specific Terms, which has been retired.

We’ve unified the effective date and the “Last Modified” date at the top of the page.
We've updated the 'Assignment' section to include clearer instructions to you in this event, such as a 30-day advance written notice of proposed mergers, reorganizations, or other significant corporate transactions, a clear path to provide notice and our commitment to provide reasonable support accommodations when proper notice is given and consent is granted.

HubSpot Business Partner Data Processing Agreement

We've added a new table of contents, updated section titles, and renumbered sections throughout the Business Partner Data Processing Agreement in an effort to ease your review.
We’ve updated ‘Schedule A’ as follows:

The 'Categories of Data Subjects' and 'Categories of Personal Data' sections now expressly include prospects and clarify data importer and data exporter roles.
The 'Nature and purpose of the processing' section now reflects obligations under the Partner Agreement and obligations under applicable law.

HubSpot App Partner Program Agreement

We’ve added a new table of contents to the App Partner Program Agreement along with updated section headers and numbering throughout the document in an effort to ease your review.

General Terms

We’re TermScout CertifiedTM! Our General Terms now include a TermScout Certified Balanced Badge, which links to our Contract Certified Report. There, anyone can view our contract analytics and benchmarking that reflects our terms are balanced based on industry standards.
In the introduction of the General Terms, we’ve retired the Jurisdiction Specific Terms lading page, and included jurisdiction-specific information as an appendix to the General Terms.
Relatedly, we’ve also added a ‘Governing Law and Jurisdiction’ section to the General Terms, and reference this same section within the U.S. Government Customer Additional Terms Appendix.
We’ve clarified Subscription Fees will not increase during your then-current term.
We’ve added information related to managing Authorized Payment Methods, including our ability to require an alternate payment method, such as in instances where we are working to mitigate payment fraud.
We’ve clarified the section title for business information in the updated ‘Company and Payment Information’ section.
We’ve consolidated the information from the ‘Data Transfers’ section into the HubSpot Data Processing Agreement section related to transfers of data.

Sensitive Data Terms

We’ve updated the Sensitive Data Terms to clarify sensitive data properties are supported in custom objects with the sensitive data designation.

Privacy Policy

We updated the ‘Information You Provide to HubSpot’ section of the Privacy Policy to reflect additional examples of how you may provide information, including to our representatives or at events.
We updated the ‘When You Visit Our Websites’ section to reflect the automated options we support, including chatbots.
The previous INBOUND section is now ‘HubSpot Events’ to more clearly capture all of our events globally, and we’ve also included information related to applicable disclosures specific to an event.
We’ve added “communication” as part of the title of the section ‘To Improve and Develop Our Communication, Product, and Services to help more easily navigate how we use data.
We worked to simplify language regarding data subject rights to complain to applicable local data protection authority, and we reiterated our commitment to work with them to resolve concerns.
We updated the ‘Google Products And Integrations’ section to include updates to services as part of the scope within the ‘Gmail Integration’ subsection, and to remove sunset extension options no longer available.

Product Specific Terms

In the ‘AI Products’ section, we made our Acceptable Use Policy available earlier in the paragraph in an effort to ease review. We also included a reference to our DPA, where you can also find information about our AI Products and data processing.
We’ve launched Multi-account-Management! You can review the Product and Services Catalog for additional details about the features, and refer to the new ‘HubSpot Multi-Account-Management’ section in the Product Specific Terms for additional conditions.

Acceptable Use Policy

We’ve fixed typos, including removing duplicate words, included the definition of “Transaction Fees” in the ‘Processing Transactions and Receiving Your Funds’ section of the Acceptable Use Policy.

Payments Terms of Use

We’ve included the definition of “Transaction Fees” in the ‘Processing Transactions and Receiving Your Funds’ section in the Payments Terms of Use. We use Transaction Fees when talking about Processing Fees and Platform Fees together.

General Terms

In the General Terms, and throughout the Agreement, we’ve worked to ease your review by consolidating information and applying consistent formatting across the documents.

We’ve added HubSpot Terms Tips that include links to knowledge base articles with additional information about the section.
We’ve updated section numbering, fonts, indentation, titles, etc.
We’ve retired the Regional Data Hosting Policy as we’ve worked to consolidate and clarify the information important to our customers in the General Terms, and reduce the number of documents requiring your review.
We’ve updated the quick-link references to match the titles of each section for continuity.

We removed repetitive clauses and references to improve clarity in the terms.

We removed references to pricing and limits from various places within the Agreement in an effort to consolidate the information in the Product and Services Catalog.

The Additional Coverage Terms, previously incorporated as Appendix 1, have been removed, and the related provisions in the General Terms have been updated, as further summarized in this Community Post.

As a result, we’ve removed “Appendix 2” from the title of the ‘U.S. Government Customer Additional Terms’ to avoid confusion with renumbering, and updated the U.S. Government Customer Additional Terms accordingly.

We made updates to the ‘Definitions’ section.

We added “Beta Services” to the definitions list in the General Terms.
We clarified the Product and Services Catalog definition.
As a result of removing Appendix 1, we’ve also removed the definition of Total Committed Subscription Value.

We’ve worked to clarify the ‘Downgrades’ section to reduce confusion.
The ‘Modifications’ section now includes language indicating changes will not materially degrade the overall functionality of the Subscription Service; there are some exceptions, so be sure to review the terms directly.
We added a paragraph to the ‘Term and Renewal’ section in an effort to provide additional, clarifying information and reduce confusion and removed the ‘Early Cancellation’ section to consolidate the information.
We’ve worked to clarify the ‘Notice of Non-Renewal’ section and reduce the number of additional references for your ease of review.
As our approach to AI and Machine Learning has matured, so has our language. Accordingly, we’ve updated the ‘Machine Learning’ section to clarify our machine learning practices.
We removed duplicate information from the ‘HubSpot Tracking Code and Customer Websites’ in an effort to consolidate the details in our Data Processing Agreement as a central resource.
The ‘Regional Data Hosting’ section now includes information about your Hosting Location and possible exceptions.

As a reminder, we’ve worked to consolidate and clarify the information important to our customers in the General Terms, so we’ve sunsetted the previous Regional Data Hosting Policy to reduce the number of documents requiring your review.

As a result of removing the Additional Coverage Terms, we’ve updated the Indemnification section to include HubSpot indemnification obligations and notice protocols.
We removed the exception for Free Services from indirect damages in the ‘No Indirect Damages’ section.
We’ve updated the Limitation of Liability section to include exceptions for HubSpot IP indemnification obligations. We also clarified the limitation is intended to the extent permitted by law.
We’ve worked to provide clarity and reduce duplication in the ‘Compliance with Laws’ section, including an update to our Code of Business Conduct and Ethics (formerly the Code of Use Good Judgment).

Data Processing Agreement

As a reminder, you’ll see we updated our numbering and headers in an effort to ease your review, and new HubSpot Terms Tips include links to knowledge base articles with additional information about the section.

In the introduction to the Data Processing Agreement, we updated references to section titles for consistency.

We’ve updated the ‘Deletion or Return of Customer Personal Data’ and ‘Data Subject Requests’ section to include that any costs will be reasonable and provided to you in advance.

We are excited to expand the data hosting options available to you!

You’ll see updates for each Sub-Processor on the Sub-Processors Page indicating how their data handling relates to each of the hosting locations we offer.

Sensitive Data Terms

We’re excited to move our Highly Sensitive Data features from Beta into GA!

We updated the Sensitive Data Terms to include some Highly Sensitive Data, such as financial account information. We’ve also provided updated examples of sensitive data that is not currently supported in our services (e.g., biometric data).

We updated the ‘HubSpot Obligations' section to reflect our physical, administrative, and technical security controls contained in the agreement.

Privacy Policy

We updated the examples of our websites where the Privacy Policy applies.
We updated the ‘Payment Information’ section that now streamlines several previous sections into a consolidated resource.
The ‘To Communicate with You About the Product and Services’ section now includes recommendations for new products and services.
As our approach to AI and Machine Learning has matured, so has our language. Accordingly, we’ve updated the ‘To Improve and Develop Our Product and Services’ section to reflect our machine learning models.
In the ‘Partners’ section, we’ve clarified your choices for disclosing Personal Information to our co-marketing Partners.
We updated the details in our ‘Data Privacy Framework Notice’ to make it clear that HubSpot is subject to the investigatory and enforcement powers of the US Federal Trade Commission.
We have updated our Cookie Policy, including our references in our Privacy Policy.
The ‘Children’s Information In the Subscription Service’ section has been updated to reflect how children’s information may be processed under our Sensitive Data Terms.

Acceptable Use Policy

We’ve worked to ease your review by consolidating information and applying consistent formatting across the documents.

You’ll see we updated our numbering and headers in an effort to ease your review and added new HubSpot Terms Tips including links to knowledge base articles with additional information about the section.
We’ve worked to provide clarity and reduce duplication in the ‘Non-Disruptive Use’ section of the Acceptable Use Policy and the ‘Compliance with Laws’ section of the General Terms.
Similarly, we consolidated the ‘Developer Obligations’ and ‘Developer Terms’ sections into a single provision.

Product Specific Terms

As noted in the General Terms, we worked to reduce and simplify the number of pages and links included in the Agreement, including the Product Specific Terms.

We’ve worked to streamline the introduction.
You’ll see references to pricing and limits removed from sections across the Product Specific terms and aligning to the Product and Services Catalog.
We removed details around product modifications and unified that information under the General Terms.

We reduced the background information in the ‘HubSpot Seats’ section in order to remove unnecessary language and streamline review.
Similarly, we removed historical information, pricing details, and limits, from the ‘Marketing Contacts’ section to avoid duplicating information.
We’ve included a “reasonable” standard for costs incurred related to data extract support.
If you use Commerce Hub, we’ve updated the Product Specific Terms to reflect billing data migration for customers looking to import information.
For clarification, we updated the ‘Communication Services’ section where the definition is incorporated within the provision.
We’ve added a ‘Hosting Location Migration’ section, including information previously provided in the retired Regional Data Hosting Policy, that applies when your account moves from one Hosting Location to another.
We streamlined the Beta Services section to align with the updates to the General Terms and Beta Terms.

Payments Terms of Use

We updated the ‘Security Interest’ in the Payment Terms of Use section to clarify third party grants or assignments to a lien on or interest in funds are not permitted until they’re deposited into your Payout Account.

Stripe Payment Processing Terms

General Terms

We’ve updated the definition of Personal Data, which now matches the definition of Personal Data in the DPA.
We worked to improve the ‘Sales Tax’ section by including additional jurisdictions subject to VAT and clarify other tax information.
The new Breeze Intelligence enrichment products are now available!

HubSpot honors customers’ choices about what data to share with us. With the release of the Breeze Intelligence enrichment products, several terms have changed across our Agreement.
To provide customers time to learn about our new services and make meaningful choices about their data sharing preferences, existing customers will have until December 1, 2024, to modify the account settings that enable HubSpot to use the HubSpot Tracking Code data to improve our products and services. If you do not update your settings by December 1, 2024, your account will automatically enable data sharing associated with the HubSpot Tracking Code.
As a result of the additional features and functionality available with Breeze Intelligence products, we updated the ‘Customer Proprietary Rights’ and ‘Limits on HubSpot’ sections to reflect updated data use.
You’ll also see new language around the HubSpot Tracking Code, which can be used with the Breeze Intelligence enrichment products.
In an effort to ease your review, we’ve included a reference to the new Controller-to-Controller terms in the DPA as it relates to the HubSpot Tracking Code and the Breeze Intelligence enrichment products, including information on how you can control data sharing from your account.

We removed the references to the previous AI Product FAQ, and now support AI technical questions in our AI Model Cards available at https://behindhubspotai.com.

Product Specific Terms

The P&S catalog now reflects the number of users supported in the Free Services, so we removed user limit information from the Product Specific terms.
Based on the updates we made to the DPA to include a definition of ‘Customer Personal Data’ we updated the Product Specific Terms to match the new terms to enhance continuity across the Agreement.
We worked to clarify language in the ‘Consulting Services’ section to clarify when the HubSpot Solutions Partner Program Agreement will apply.
The new Breeze Intelligence enrichment products are now available!

We replaced the legacy ‘Insights and Enrichment Data’ section with the new ‘HubSpot Enrichment Products’ section.
This section also includes information that applies when you use the HubSpot Tracking Code.
This is where you can learn how data may be ingested into the HubSpot commercial dataset based on your account and configuration choices.

Sensitive Data Terms

HubSpot now supports Protected Health Information subject to HIPAA! We’ve updated the Covered Services Table to include:

Permitted Sensitive Data to include HIPAA data
Additional Covered Services supporting all Sensitive Data types

HubSpot now supports Highly Sensitive Data as a Beta Service, so we’ve similarly updated the Beta Covered Services table to reflect Highly Sensitive Data as Permitted Sensitive Data.
Based on the updated scope of Permitted Data and Covered Services, we’ve updated the definition of Prohibited Sensitive Data to more accurately reflect what data is now prohibited.

Data Processing Agreement

We’ve made changes throughout the Data Processing Agreement to reflect HubSpot processing data in two ways: as a Data Processor and as a Data Controller. Please review the DPA directly for specific details.
In an effort to provide terms that are clear and understandable, we’ve updated the introduction of the DPA to clarify where HubSpot may act as a Data Processor and where HubSpot may act as a Data Controller. We’ve also updated the section links to match the updates throughout the document.
We’ve updated several subsections within the ‘Definitions’ section of the DPA:

The definitions section now includes ‘Controller Personal Data’ and ‘Customer Personal Data’ as defined terms, which you’ll see used throughout the updated terms.
The definitions section includes an updated term for ‘Customer Personal Data Breach’, which you’ll see used throughout the updated terms.
The definition of ‘Data Protection Laws’ was updated to include references to India and Canada for the avoidance of doubt.
The definitions section includes an updated term for ‘Restricted Transfer’, which you’ll see used throughout the updated terms.

The ‘Customer Responsibilities’ section now includes requirements reflecting adequate notice for data subjects and honoring opt-out preferences.
If you would like to delete data from HubSpot, you can export your content and delete your information by following the steps in this knowledge base article. You do not need to submit a request to delete or export data, so we’ve updated the terms of the DPA accordingly.
We’ve updated the ‘Transfer Mechanism’ section in the DPA, including the Data Privacy Framework information, applicable Standard Contractual Clauses, and other alternative transfer mechanism details.
We’ve included a new ‘Controller-to-Controller’ section in the DPA as it relates to the HubSpot Tracking Code and the new Breeze Intelligence enrichment products. As a result, we also made the following changes:

We added “HubSpot as Processor” to the title of ‘Annex 1A - Details of Processing - HubSpot as Processor.’
We included ‘Annex 1B - Details of Processing - HubSpot as Controller’ in the DPA, including the applicable details.

We updated the Sub-Processors Page incorporated into the DPA to update and sub-processor entity names and use case language as part of our ongoing diligence.

Regional Data Hosting Policy

We’ve updated the Regional Data Hosting Policy throughout the document, so be sure to refer to the RDHP directly for details.
We refined the introduction of the RDHP in an effort to be more concise.
We will align future updates to the RDHP with the notice process for the Terms of Service, so we removed the language relating to separate notice requirements.
The ‘Regional Data Hosting and Customer Data’ section has been redrafted to include detailed information in a more clear structure in an effort to easily address common hosting questions.
We updated the RDHP entity information, use cases language, and location details as part of our ongoing diligence.

Privacy Policy

In an effort to provide terms that are clear and understandable, we’ve updated the introduction of the Privacy Policy to illustrate instances where HubSpot may act as a Data Processor or as a Data Controller.

We’ve made changes throughout the Privacy Policy to reflect how HubSpot processes personal data for its own purposes, as a data controller.
You can review the HubSpot DPA for more information about how we process personal data in other ways.
We’ve also updated the quick links following the introduction for your ease of reference.

We updated the ‘Google Products and Integrations’ language to align with third-party requirements and reorganized the terms into a new section in an effort to ease review.
The new Breeze Intelligence enrichment products are now available!

HubSpot honors customers’ choices about what data to share with us. With the release of the Breeze Intelligence enrichment products, several terms have changed across our Agreement.
To provide customers time to learn about our new services and make meaningful choices about their data sharing preferences, existing customers will have until December 1, 2024, to modify the account settings that enable HubSpot to use the HubSpot Tracking Code data to improve our products and services. If you do not update your settings by December 1, 2024, your account will automatically enable data sharing associated with the HubSpot Tracking Code.
We’ve added the ‘Information We Collect and Process in Connection with our Enrichment Products’ section, accordingly. If you’d like to remove your Personal Data from our commercial dataset, complete and submit this form.

Accepted solutions help you find answers faster – when you’re searching for information in the Community, you can use this filter to only see solved posts:

We wanted to give you some information on what's changed. Please remember that this is just an informal, high-level summary of the most recent changes to these documents, and that you should always make sure you’ve read and understood the complet Customer Terms of Service before you use our products or services.

We’ve also made minor drafting clean-ups and clarifications across the terms.

General Terms

We are excited to support Sensitive Data in HubSpot! We have incorporated our Sensitive Data Terms into the General Terms (more details in the Sensitive Data Terms section below), and we made changes throughout the terms to support this shift.

We removed the previous definition for “Sensitive Information” under our terms; you can find the updated information in the HubSpot Sensitive Data Terms.
Similarly, we removed the previous restrictions prohibiting sensitive data, and now allow Permitted Sensitive Data within the Covered Services, as detailed in the HubSpot Sensitive Data Terms.

We moved the User access credential information from the ‘Acceptable Use’ section to the ‘Access’ section to group similar information together in an effort to simplify review.
While our practices have not changed, we updated the language under the ‘Effect of Termination or Expiration’ section to clarify unpaid fees remain due and remove possibly confusing phrasing.

Product Specific Terms

We updated the knowledge base article information in the ‘Retrieval of Customer Data’ section for your ease of reference.
Under the ‘Marketing Contacts Products Email Send Limit’ section, we’ve removed the duplicate limit information and included a link to the Product & Services Catalog for up-to-date information regarding limits, tiers, add-ons, and more.
We corrected legacy references from “Subscription Term” to “Current Term,” where applicable.
We added information to the introduction of the ‘Commerce Hub’ section, which includes a short description of Commerce Hub, Stripe payment processing, and HubSpot payments, to help illustrate how the features are distinguishable from one another and how they may work together. Given this restructuring, we removed the prior sections regarding Stripe payment processing and HubSpot payments.
The ‘HubSpot Payments Terms of Use’ were updated to include the Platform Fee and the Processing Fee (more details in the HubSpot Payments Terms of Use section below); the ‘Commerce Hub’ section of the Product Specific Terms reflects similar updates for consistency.
We updated the ‘WhatsApp Integration’ section to reflect updated product functionality that allows for integration with your HubSpot Account, generally, rather than specifically as a channel or through your inbox.

Sensitive Data Terms (NEW!)

We are excited to support Sensitive Data in HubSpot! The Sensitive Data Terms, available at https://legal.hubspot.com/sensitive-data-terms, apply to eligible customers who choose to enable the Sensitive Data functionality.

Legacy Marketing Hub

We updated the definition of ‘Marketing Hub Products’ to remove the specific product examples.
Under the ‘Marketing Hub Subscription Fee and Limits’ section, we’ve removed the duplicate limit information and included a link to the Product & Services Catalog for up-to-date information regarding limits, tiers, add-ons, and more; accordingly, we’ve also removed the prior Marketing Hub Email Send Limit section.
We corrected legacy references from “Subscription Term” to “Current Term,” where applicable.
We updated the knowledge base article information in the ‘Retrieval of Customer Data’ section for your ease of reference.

Data Processing Agreement

Similar to the updates in the General Terms and the Sensitive Data Terms, we have updated the Data Processing Agreement throughout the document to now support sensitive data.

We removed the exclusion for sensitive data in the “Data Protection Laws” definition.
In Annex 1 - Details of Processing, under the ‘Description of Transfer’ section, the Categories of Personal Data Transferred now includes processing of Sensitive Data.

We updated the knowledge base article information in the ‘Deletion or Return of Personal Data’ section for your ease of reference.
We’ve updated ‘Annex 2 - Security Measures’ to include additional details regarding our security protocols.

We’ve added the ‘Information Security Policy’ section to reflect our internal controls regarding implementation and adherence to policies and procedures. You can visit the HubSpot Trust Center, which provides an overview of our security standards.
In the ‘Physical and environmental security’ section, we clarified the physical and environmental security controls are supported by our infrastructure providers.
We updated the ‘Application Programming Interface (API) access’ section to reflect the standards included in our Security Overview. You can learn more about APIs in this KB article.
We added the ‘Endpoint Harding’ section with details about our endpoint safeguards.
The ‘Penetration testing’ and ‘Bug bounty’ sections moved under the new ‘Vulnerability Management Program’ section, which also includes additional new subsections for ‘Vulnerability Remediation Schedule’ and ‘Vulnerability scanning.’
We added the ‘Privileged Access Management’ section to describe how we may support your account within standard protocols.
The ‘Background check’ information moved under the new ‘Personnel Management’ section.
We updated the description of encryption capabilities in line with supported functionality.
The section previously titled 'Input Control' is now 'Incident Management, Logging, and Monitoring.'
We’ve added the ‘Incident Response Plan’ section to reflect our internal controls regarding implementation and adherence to policies and procedures.
In the ‘Online replicas and backups’ section, we clarified the Online replicas and backups section to reflect the nature of redundant instances.
We added a new section reflecting ‘Personnel Management’ and the efforts we take to employ qualified staff.

Sub-Processors Page

We’ve updated the Litmus Software, Inc. processing location, including for data subjects in the EU, to the United States if you choose to engage with the functionality they support.

Regional Data Hosting Policy

We added Litmus Software, Inc. as a Sub-Processor processing personal data in the United States.

Jurisdiction Specific Terms

The Governing Law for the United Kingdom now includes Wales.

Jurisdiction Specific Terms - Australia/New Zealand

We’ve updated the knowledge base article information to direct to updated titles and URLs.
We refined the ‘Effect of Termination of Expiration’ section to clarify the additional language does not apply where the agreement is terminated for cause.

HubSpot Payments Terms of Use

We have updated the “Fees'' section to now include any applicable Platform Fee for HubSpot payments. Accordingly, You’ll see updates throughout the page referring to the Platform Fee or Processing Fee, as applicable.
We’ve updated the ‘Termination’ section to include your discontinued use of the payments services as a termination option.

How to Delete Your HubSpot Community Profile

If you need to delete your HubSpot community profile, here are the steps you can follow. Please note that once your account is closed, it cannot be reopened. You will need to register again if you decide to return.

Steps to Delete Your Account:

Click on your profile picture.
Select 'Settings'.
Choose 'Close Account'.

What Happens After You Close Your Account:

Posts and Comments: Your posts and comments will remain visible in the community but will be attributed to @Anonymous.
Username and Re-registration: Your username will become available for new users. If you decide to return, you will have to create a new profile from scratch.
Media and Messages: Any media you uploaded will remain; however, your personal gallery will be inaccessible. All private messages will be permanently deleted, ensuring your privacy.
Search Visibility: Your profile will no longer appear in search results, and any direct links to your profile will show a “page not found” message.

We understand that change is constant. Whether your job or title has evolved, or perhaps you feel that “MemeLord2017” doesn’t quite resonate with your professional image anymore, we’ve got you covered.

Steps to change your username:

Make sure you are logged in to your Community Account
Click the dropdown icon next to your profile and select settings

Click Personal > Username

A few things to keep in mind as you choose your new username:

Have fun, but make good decisions with your username choice.
Usernames must be in alignment with our Community Guidelines, fostering a respectful and positive environment for all.
Usernames have a limit of up to 15 characters, so pick something concise and memorable.
Community usernames support these characters:
